'Kilmar Abrego Garcia is free' | Wrongfully deported Maryland man released, heading home with private security, attorney says​


"Today, Kilmar Abrego Garcia is free," his attorney, Sean Hecker, told WUSA9. "He is presently en route to his family in Maryland, after being unlawfully arrested and deported, and then imprisoned, all because of the government’s vindictive attack on a man who had the courage to fight back against the Administration’s continuing assault on the rule of law. He is grateful that his access to American courts has provided meaningful due process."

Abrego Garcia’s grant of relative freedom, his first since he was unlawfully deported to El Salvador in March in violation of an immigration judge’s order, may be brief. Immigration and Customs Enforcement (ICE) officials have said the agency will seek to swiftly detain and begin removal proceedings to a third, as-yet-unidentified country once Abrego Garcia is no longer in the custody of U.S. Marshals.

Last month, a federal judge in Maryland barred ICE from immediately re-arresting Abrego Garcia. U.S. District Judge Paula Xinis ordered him returned to the same supervision conditions he was under prior to his deportation in March. She also ordered ICE to provide at least 72 hours’ notice before initiating any new efforts to remove Abrego Garcia from the country.

What’s next?​

After being released Friday, Abrego Garcia will have 48 hours to return to Maryland before he has to report for pre-trial supervision. A private security firm hired by his legal team will help bring him back from Tennessee to Maryland.

There, his legal fights will continue on two fronts. Earlier this week, attorneys from the New York law firm Hecker Fink representing Abrego Garcia in his criminal case filed a motion to dismiss for vindictive prosecution. The evidence of that, they say, is clear — from a whistleblower complaint filed by former Justice Department lawyer Erez Reuveni, who claims he was fired after refusing to file a misleading brief in the case, to unsubstantiated but highly publicized claims that Abrego Garcia is a member of MS-13.
“This case results from the government’s concerted effort to punish him for having the audacity to fight back, rather than accept a brutal injustice,” his team wrote in the motion.

Last month, U.S. District Judge Waverly Crenshaw warned attorneys to limit any extrajudicial statements about the case. The warning came after attorneys for Abrego Garcia highlighted repeated attacks against their client on social media by the Department of Homeland Security.

“Our Constitution requires that Abrego is presumed innocent unless and until proven guilty beyond a reasonable doubt by a jury,” Crenshaw wrote.

A separate group of attorneys representing Abrego Garcia in Maryland is also fighting to ensure he receives the due process he was denied last time. Abrego Garcia, who had legal authorization to work in the U.S. until 2029, says he was repeatedly told, falsely, that he would have the opportunity to see a judge after he was arrested by ICE in March. Instead, he was deported without a hearing to El Salvador’s notorious CECOT prison. There, according to a filing in July, he was threatened and tortured.
Xinis, whose order currently bars Abrego Garcia from being deported without at least 72 hours’ notice, expressed her repeated frustration during a series of hearings last month about the government’s inability, or unwillingness, to provide clear answers about what would happen if he was released from DOJ custody.

“It’s like trying to nail Jell-O to a wall trying to figure out what’s going to happen,” Xinis lamented at one point.

Why was Abrego Garcia released?​

Abrego Garcia’s release has been delayed for months since Magistrate Judge Barbara D. Holmes in Tennessee first ordered it on June 22. Holmes, who acknowledged Abrego Garcia was likely to go immediately into ICE custody, said federal prosecutors had failed to show he was a danger to the community or a flight risk.

Crenshaw, who was appointed to the federal bench in 2016 by former President Barack Obama, upheld that order last month. Crenshaw said the Trump administration had failed to back up its allegations that Abrego Garcia is a member of MS-13.

“There is no evidence before the Court that Abrego: has markings or tattoos showing gang affiliation; has working relationships with known MS-13 members; ever told any of the witnesses that he is a MS-13 member; or has ever been affiliated with any sort of gang activity… Based on the record before it, for the Court to find that Abrego is member of or in affiliation with MS-13, it would have to make so many inferences from the Government’s proffered evidence in its favor that such conclusion would border on fanciful,” Crenshaw wrote.

Federal prosecutors have sought to have Abrego Garcia remain in custody – in part because, they warned, ICE would likely swiftly remove him from the country again if he was released.

Abrego Garcia was returned to the U.S. in June to face federal human smuggling charges stemming from a 2022 traffic stop in Tennessee. During the stop, which did not result in any charges, Abrego Garcia was found to be driving an SUV with eight passengers, none of whom had identification. Abrego Garcia told Tennessee Highway Patrol troopers he and his passengers had been in St. Louis doing construction work. According to charging documents, investigators believe the vehicle Abrego Garcia was driving had actually been in the Houston area.

The Justice Department has accused Abrego Garcia of being part of a nationwide human smuggling operation that moved firearms, narcotics and undocumented immigrants from Texas to multiple states, including Maryland.

Abrego Garcia is scheduled to stand trial on those charges in a Tennessee federal court in January. He has denied any association with MS-13 or involvement in a human smuggling ring. His attorneys have accused the Trump administration of ginning up federal charges against him as a way of saving face after the Supreme Court ruled unanimously on April 10 that the government must “facilitate” Abrego Garcia’s return to the country.

Massive immigration raid at Hyundai megaplant in Georgia leads to 475 arrests. The majority are Korean​



Hundreds of federal officers descended on a small southeast Georgia community and raided the Hyundai Metaplant – arresting 475 people in one of the largest sweeps yet in the Trump administration’s immigration crackdown at workplaces across the US.

The majority are Korean nationals, said Steven Schrank, a Homeland Security Investigations special agent in charge. The raid marks the largest single-site enforcement operation in HSI history, he said, though a host of other federal agencies were also involved.

Previously, federal officials estimated 450 people were apprehended Thursday at the massive site in Ellabell, about 25 miles west of Savannah, Georgia.

All 475 people taken into custody were illegally present in the US, Schrank said. Some crossed into the US illegally, some had visa waivers and were prohibited from working, and some had overstayed their visas, he said.

Schrank said he did not have a breakdown of the arrestees’ nationalities.

During the raid, several people tried to flee – including some who “ran into a sewage pond located on the premises,” the US Attorney’s Office for the Southern District of Georgia said.

“Agents used a boat to fish them out of the water. One of the individuals swam under the boat and tried to flip it over to no avail. These people were captured and identified as illegal workers.”

Schrank noted that some of the workers may have been contractors or subcontractors. A Hyundai spokesperson told CNN he does not believe anyone arrested was a direct employee of Hyundai Motor Company.

“We are aware of the recent incident at the HL-GA Battery Company construction site in Bryan County, Georgia. We are closely monitoring the situation and working to understand the specific circumstances,” spokesperson Michael Stewart said Friday.

“As of today, it is our understanding that none of those detained is directly employed by Hyundai Motor Company. We prioritize the safety and well-being of everyone working at the site and comply with all laws and regulations wherever we operate.”


The sprawling, 2,900-acre Hyundai Metaplant has two parts: a Hyundai electric vehicle manufacturing site, and an EV battery plant that’s a joint venture between Hyundai and LG.

CNN has reached out to LG for comment.

The raid halted construction of the EV battery plant, the Associated Press reported.

The same day, hundreds of miles away in upstate New York, dozens of workers at a family-owned plant that makes nutrition bars were also apprehended during an ICE raid, officials said, drawing the ire of Gov. Kathy Hochul.

The raids come as Chicago leaders are preparing for a possible National Guard deployment in step with an expected immigration enforcement operation in the city.

GOP governor promoted the Metaplant​

At the Georgia site, masked and armed agents gave orders to construction workers wearing hard hats and safety vests as they lined up while officers raided the facility, video footage obtained by CNN showed.

ICE and Homeland Security Investigations were accompanied by the Georgia State Patrol, the FBI, DEA, ATF and other agencies in executing a search warrant as part of an ongoing criminal investigation into “allegations of unlawful employment practices and other serious federal crimes,” the Department of Homeland Security said in a statement. “Together, we are sending a clear and unequivocal message: those who exploit our workforce, undermine our economy, and violate federal laws will be held accountable.”

ATF Atlanta said the operation led “to the apprehension of ~450 unlawful aliens, emphasizing our commitment to community safety.”

Republican Gov. Brian Kemp has touted the Hyundai Metaplant as a boon for the Georgia economy.

In 2022, Hyundai announced an agreement with the state of Georgia to build Hyundai’s “first dedicated fully electrified vehicle and battery manufacturing facilities in the United States” in Bryan County, the company said.

The Metaplant was expected to create 8,500 jobs.

“With the first 500 employees trained, and more soon to join them, this is another major milestone as we continue our momentum towards the full opening of the Hyundai Metaplant!” Kemp posted on social media last year.

CNN has asked Kemp’s office for comment about Thursday’s immigration raid at the Metaplant.

Dozens apprehended in New York raid​

In New York Thursday morning, federal agents arrived at the Nutrition Bar Confectioners plant in Cato and questioned “virtually the entire workforce,” according to Rural & Migrant Ministry, whose staff witnessed the raid.

The group posted a video on its Facebook page showing law enforcement leading people into a van marked “Border Patrol.” During the raid workers were taken into the kitchen area of the plant and “questioned one by one over the course of many hours,” the group said in the post.

The group estimates that “upwards of 70 employees” were questioned and “nearly all” were then arrested and taken to the nearby Oswego Detention Center. A spokesperson for the group told CNN they’re still waiting to hear from authorities about exactly how many were detained.

Hochul condemned the ICE operation in her state.

“I am outraged by this morning’s ICE raids in Cato and Fulton, where more than 40 adults were seized — including parents of at least a dozen children at risk of returning from school to an empty house,” Hochul said in a statement.

Hochul said such operations “will not make New York safer” and will “shatter hard-working families who are simply trying to build a life here."
ICE confirmed to CNN affiliate WSTM that it carried out a “court-authorized enforcement action” in Cato. Employees told WSTM that around 60 workers were detained. CNN has reached out to the agency for further details.

Mark Schmidt, the owner of Nutrition Bar Confectioners, told the New York Times that all his workers had legal documentation to work in the US. “We’ve done everything we can to vet people we hire,” he said.

Schmidt described the ICE raid as “overkill.” His son Lenny Schmidt, the company’s vice president, told the Times the scene was “almost theatrical,” describing police dogs and all-terrain vehicles involved in the operation.

“It could have been handled so much more humanely and decently,” he said. “This kind of raid, you feel like it’s a drug bust or a human trafficking situation.”

LG and Hyundai hiding behind using 3rd party contractors which hire illegals instead of having employees


Hyundai Motor's U.S. subsidiary said on the 5th (local time) that it is "thoroughly checking the employment practices of contractors and subcontractors" in connection with the crackdown on illegal immigrants at the joint battery plant construction site of Hyundai Motor Group-LG Energy Solution in Georgia.

"We are reviewing our process to ensure that all stakeholders participating in the project maintain the same level of legal compliance standards as we do," Hyundai Motor's U.S. subsidiary said in a statement.

Hyundai Motor's U.S. subsidiary said, "We are doing our best to thoroughly comply with laws and regulations in all markets that operate our business, and this includes employment verification requirements and immigration laws," adding, "We expect the same level for all suppliers, including subcontractors." "Hyundai Motor applies the zero tolerance principle to those who do not comply with the law," he said. "We will strictly comply with U.S. laws in the process of investing in U.S. manufacturing and creating thousands of jobs."

The U.S. Immigration and Customs Enforcement (ICE), the Homeland Security Investigation Agency, the Drug Enforcement Agency (DEA), and the Georgia State Patrol arrested 475 people after conducting a massive crackdown on illegal immigrants at Hyundai Motor Group-LG Energy Solution's joint battery plant construction site on the 4th. Of these, 300 are believed to be Korean nationals, and none of the detained personnel are directly employed by Hyundai Motor.
