27th Amendment ‘dethrones’ Supreme Court, legal experts warn​

ISLAMABAD: The initial draft of the 27th Constitutional Amendment Bill, tabled in the Senate on Saturday, has led many legal experts to believe that the tweaks would, in effect, dethrone the Supreme Court as the country’s highest judicial forum, ceding that position to a proposed Federal Constitutional Court (FCC).

However, proponents of the amendment say the new constitutional court would modernise the judiciary, reduce backlogs and separate constitutional and appellate jurisdictions — a reform they argue will improve efficiency and clarity in the justice system.

“Left with a limited jurisdiction of deciding ordinary civil, criminal and statutory appeals, the Supreme Court has now become all the more a ‘Supreme District Court’,” remarked a senior counsel who asked not to be named.

He warned that the government could now amend laws like the Elections Act 2017 and others to route appeals to the FCC instead of the Supreme Court.

Amendment to Article 175, he said, was “virtually the end of the judiciary as we knew it”, arguing that the Supreme Court had been “amended out of the Constitution by making it irrelevant”.

Former additional attorney general Tariq Mehmood Khokhar said the essence of the package was twofold.

First, the insertion of a new Chapter 1A in the Constitution that, in his view, tightens executive control over the superior judiciary through expanded powers to transfer high court judges, and establishes an FCC “empowered by disempowering the Supreme Court”.

Second, an amendment to Article 243 that formally vests the office of Chief of the Defence Forces in the Chief of the Army Staff and constitutionally guarantees the Field Marshal rank for life.

Another lawyer, also speaking on condition of anonymity, said that although the senior-most of the two chiefs would chair the Judicial Commission of Pakistan, “for all other purposes, the FCC will be in the commanding position”.
 
Pakistan Peoples Party (PPP) chairman Bilawal Bhutto Zardari said the party would support amendments to Article 243, which defines the powers of the armed forces, in the proposed 27th Constitutional Amendment.

Addressing the media following the conclusion of the Central Executive Committee (CEC) meeting, Bilawal said the moot debated the matter of constitutional courts for two days and the party “agrees in principle with the idea that constitutional courts should be formed”.

“In the 27th Amendment, the amendment to (article) 243 must be accepted.”

The party chairperson added that “unfinished agenda items” from the Charter of Democracy were also discussed.
 
On Saturday afternoon, the federal cabinet approved the bill for the 27th Constitutional Amendment, welcoming it to “the fullest extent.”

Subsequently, it was tabled before the Senate, triggering noisy protests from the opposition over the pace and scope of the proposed changes.

PM Shehbaz was elected as the 24th premier of Pakistan in the 2024 general elections. Article 95 of the Constitution of Pakistan allows for a prime minister to be impeached via a no-confidence motion.

It states: “A resolution for a vote of no-confidence moved by not less than twenty per centum of the total membership of the National Assembly may be passed against the Prime Minister by the National Assembly.”

A Senate session has been convened today — on a Sunday in a rare move — with a one-point agenda to deliberate on the bill for the 27th Constitutional Amendment.

The 26-page Constitution (Twenty-Seventh Amendment) Act, 2025 was tabled in the Senate yesterday amid the opposition’s outcry over the pace and scope of the proposed changes, just hours after its approval by the federal cabinet.

Addressing the upper house of the parliament, PTI Senator Ali Zafar detailed “five points” that he said formed the basic spirit of the 1973 Constitution and were now being “punctured” in the 27th Amendment.

Huh? Who said Imran Khan can solve ALL of Pakistan’s problems? Not even his own supporters believe that. However, his current fight against the blood sucking military establishment from his prison cell is worthy of admiration — unless of course you’re a Bughaz-e-Imrani and thus are unable to acknowledge absolutely anything positive about him. 🤭
 
I think India should stop trying to fight Pakistan army.
Wirh this Amendment The Pakistan army went into self destruction.
The Government of Pakistan 27th Ammendment.
As per the new law the Field Marshall will be the sole leader of all 3 forces.
The Field Marshall will be a lifetime position.
The Field Marshall will be protected by law same as the president.
Meaning he can only be impeached by the parliament and immune to any police or court case.

All this means that Asim Munir will be calling the shots all the way to his death bed.
Usually after 70 even doing a no 2 is as difficult as a military operation.
A decade from now Pakistan army and other two forces will have a guy on the top who will need bedpan.

Likewise military officers will have a limited incentive or interest in performance, as they know the position or army cheif is blocked by a guy whos there until his death, so why bother performing well and aim for promotions.

This is a recipe for self destruction.

Munira TT and government nexus, via this constitutional Ammendment are abolishing CJSC position in Pakistan army.
So far Pakistan army had only two Full generals. One COAS , which is Munira TT , and the other was Chairman joint cheif of staff committee, CJSC.
He was the commander of the core capabilities of Pakistan army , including nuclear, and was not under the COAS. The CJSC was the one who coordinated with other two forces the Navy and the Air Force.
That position will be abolished from 25th of November.
A new post will be created to lead the nuclear forces , and that new guy will be under Asim Munir.
Unlike previously if COAS Asim Munir said he wanted to start a nuclear war, the actual commander who knew all the codes the CJSC and wasn't under COAS , instead was directly under the president, and could refuse to Asim Munir.
That layer of safety is now gone.
Likewise now all 3 forces are under Munir Law and their independent planning and decision making is now gone. An army guy who knows zilch about Air force and Navy will be making decisions for them, bypassing their own chiefs.

Stop spreading lies. The dual citizenship will only apply to Govt officials, Military and members of National and provisionsal assemblies and the Senate.
 
It is interesting to note that Afghandus, PTI aka Imran Khan's ball lifters and Taliban accounts have started to spread lies and fake propoganda against the constitutional changes. WHAT DOES THIS TELL YOU?? THIS TELLS THAT ALL THESE APES ARE OF THE SAME NETWORK CONTROLLED BY FOREIGN POWERS. NOW WHY WOULD TALIBAN BE SUPPORTING PTI??

It does feel like Pakistan now needs a "No kings" movement as well now, as that is where Pakistan is right now.

you do know CJSC was a useless seat with no power , also didnt you guys already tell us that army was under full control of muneer so nothing has changed . we laready know he was immune and would get as many extensions as he wants now its just in writing
