Certain officers will receive constitutional protection — removable only through the procedure outlined in Article 47 — along with presidential-level immunity.

A new chapter, creating the Federal Constitutional Court, grants the body original jurisdiction over constitutional disputes involving the government and all matters relating to fundamental rights. Petitions or appeals pending before the Supreme Court will be transferred to the new court. The amendment also abolishes the Supreme Court’s suo motu powers and removes Articles 184, 186 and 191A from the Constitution.

Four judges of the Islamabad High Court have prepared a draft petition to challenge the 27th Constitutional Amendment, it is learnt on Thursday.

According to the sources, a draft petition has been prepared and forwarded to the apex court for filing, with the formal submission expected later.

Justices Mohsin Akhtar Kiani and Babar Sattar are among the applicants, while Justices Saman Rafat Imtiaz and Sardar Ejaz Ishaq Khan are also part of the group contesting the legislation.

However, sources within the Supreme Court said, no petition from the Islamabad High Court judges had been received so far. Officials of the newly established Federal Constitutional Court similarly stated that they also had not yet received any application challenging the amendment.

The 27th Constitutional Amendment, which became law after receiving the president’s assent, has triggered widespread criticism from opposition parties, lawyers, judges and legal commentators, who have described it as an assault on the constitutional and fiduciary principles.

In protest over the amendment’s approval, the senior-most judges of the Supreme Court — Justices Mansoor Ali Shah and Justice Athar Minallah — resigned, calling the move 'a grave assault on the Constitution of Pakistan'.

The fallout has continued to deepen, fuelling speculation that more resignations may follow. Under the new constitutional framework, the Supreme Court now stands subordinate to the Federal Constitutional Court.

The amendment introduces sweeping institutional changes. Under revised Articles 199 and 200, the president is empowered to transfer high court judges between provinces on the recommendation of the Judicial Commission, with any judge declining transfer, deemed retired.

Article 248 has been amended to grant the president lifetime legal immunity, which is waived only if the individual assumes public office again.

Changes to Article 243 abolish the office of the Chairman Joint Chiefs of Staff Committee from November 27, 2025, concentrating strategic military authority under the Chief of the Defence Forces.

Where were these judges when they allowed the Constitution to be violated by not holding the elections, then banning a party without cause, then gifting free seats

Rhis isnt about constitution but for them to avoid "transfers" .. otherwise 28 amendment was done legally but seats awarded by such judges was illegal..they should put themselves in jail

Its rarely been the military but always the judiciary that did martial law and destruction of the Constitution

Exactly! Even the top judges of Pakistan only ever care about their own jobs & lifelong perks. 🙄

Instead of the senior judges being given an audience, they were told to take their issues to the Federal Constitutional Court. In other words, the petitioners were told to seek justice from an institution whose very creation they were there to challenge.

All this idiot judges deserved this for not siding with Pakistani Awam when their public mandate was stolen by the military establishment on February 8, 2024. 🙄

In real terms the Constitution was amended not violated (violated in Spirit)

The actual violation was done ny the judiciary by taking the PTI sign and then shamelessly not doing an election or violating and giving PTI seats to PMLN (alloted seats fix seats)

That was constitution violation not this, this is just a concern because they are worried about transfers

Nothing to do with constitution

So this judges should take a cup if water and comit suicide in it, they violated the Constitution far more, one can argue they lost their privileges because of doing it..alas there assurance were not followed on by the establishment (you/judges violate the Constitution and we will protect you)

Judge wont be able to engage in blackmail if they can just be transferred out. They also dont want to live in the boonies.

Judges have proven same as faujis, bureaucrats, politicians. At the end of the day their pay, pension, privileges and lifestyles are the most important things to them, not Pakistan.

In Pakistan its the judiciary and beuacrats that are the problem not the military. They are true inheritor of british raj

Solution is to sell everything and limit their role but that wont happen because they have the power to divide and rule..hence their corruption is now halal corruption
 
PESHAWAR: The Khyber Pakhtunkhwa Assembly has passed a unanimous resolution calling for amendments to the Constitution for the creation of a separate Hazara province, The News reported on Tuesday.

The resolution asked the KP government to undertake the consultative process and fulfil all requirements necessary for establishing basic infrastructure for the proposed province.

The joint resolution was tabled by Pakistan Tehreek-e-Insaf MPA Nazir Ahmad Abbassi and was co-signed by Pakistan Peoples Party (PPP) parliamentary leader Ahmad Karim Kundi, and MPAs Sardar Mohammad Riaz, Iftikhar Jadoon, Ikram Ghazi and Sajjadullah.

"Keeping in view the historical and cultural identity, administrative requirements, proper representation, and longstanding demand of the people of Hazara, the federal government, under Article 239 of the Constitution of Pakistan, should initiate the constitutional process for the creation of Hazara province," the resolution stated.

It added that the KP government should complete all prerequisites so that the people of Hazara may obtain their separate province.

The resolution asked the provincial government to make arrangements for the infrastructure, jurisdiction, and administrative structure of the new province and present recommendations to the relevant forums to avoid any constitutional hurdles in its formation.

It is worth mentioning that this is the third time the KP Assembly has passed a resolution in favour of Hazara province. The first one was passed on March 21, 2014, and the second on January 4, 2022, reaffirming support for the 2014 resolution.

Chaired by KP Assembly Speaker Babar Saleem Swati, the Hosue also passed several other resolutions, including one by PPP's Ahmad Karim Kundi to declare former prime minister and PPP founder Zulfikar Ali Bhutto as a "Shaheed" (martyr) in the official record.

"Keeping in view the political and social services of Zulfikar Ali Bhutto for a stable, democratic and prosperous Pakistan, he should be declared as Shaheed at the official level," Kundi's resolution stated. It was passed unanimously.

ANP's Nisar Mohammad Baz, through another resolution, urged the provincial government to curtail the powers of deputy commissioners under 3MPO and 16MPO, which he said were often used against political workers for arrests and harassment.

He demanded the withdrawal of what he termed "fake FIRs" against political workers and an end to political victimisation by district administrations and police officials.
