Again, if Russia did not nationalise those EU asset (which is in effect confiscating those asset), then EU cannot confiscated the Russian asset as it was just fronzen, Russia still the owner of those asset and International Law of Sovereign Immunity would still applies.
However, this is no longer the case, when Russian already nationalised EU asset in Russia since 2023. So this now become a compensation, again, I will find it hard to believe any court, not just EU court, will side with Russia when they were the one that nationalised the EU asset first to begin with. Once you did that, the Russian Asset is fair game.
