Imran, Bushra Bibi indicted in Toshakhana reference

An Islamabad accountability court on Tuesday indicted former prime minister Imran Khan and his wife Bushra Bibi in the Toshakhana reference.

In August last year, Imran was sentenced to three years of imprisonment by an Islamabad trial court in a separate Toshakhana case. The case, filed by the Election Commission of Pakistan (ECP), had accused the PTI leader of not mentioning the details of state gifts in his tax declarations.

Later, the IHC had set aside the sentence and ordered his release. However, he was not freed as he was undergoing trial in the cipher and other cases.

On Dec 19, the National Accountability Bureau (NAB) filed a fresh reference against Imran and his wife in an accountability court for retaining a jewellery set received from the Saudi crown prince against an undervalued assessment.

The anti-graft watchdog alleged in the reference that during his term as prime minister, Imran and his wife had received a total of 108 gifts from different heads of state and foreign dignitaries.

“Out of these 108 gifts, the accused persons retained 58 gift boxes/sets against an undervalued amount of Rs142.1 million as assessed by appraisers,” the reference said.
During the hearing today — which was held at Adiala Jail — Imran, his spouse, PTI lawyers Shoaib Shaheen and Barrister Umar Niazi appeared in court. NAB prosecutors Sardar Muzaffar and Amjad Pervaiz were also in attendance.

As the proceedings commenced, accountability judge Muhammad Bashir indicted the PTI founder and his wife and read out loud the charges framed against them.

The election tribunal upheld the rejection of former prime minister Imran Khan's nomination papers for Lahore's NA-122 and PS 89 of Mianwali, resulting in his exclusion from the upcoming general elections.
Justice Tariq Nadeem, presiding over the election tribunal at the Lahore High Court, dismissed the appeal pertaining to the rejection of PTI founder Imran Khan's papers for NA-122.

The tribunal upheld the returning officer's (RO) decision, which stated that the candidate's endorser did not belong to the constituency.
Similarly, Judge Chaudhry Abdul Aziz dismissed Imran's appeal for NA-89, supporting the RO's objections.

The tribunal noted that Imran's conviction in the Toshakhana case makes him ineligible to contest the election, emphasising that the length of the sentence is irrelevant till a sentence is in field.

Following the decisions, Imran's counsel, Advocate Umair Niazi, said he intended to challenge them in the high court's in front of a larger bench.

On December 30 the Election Commission of Pakistan (ECP) rejected Imran's nomination papers due to his conviction in the Toshakhana case, highlighting that according to the prevailing circumstances, he remains ineligible to participate in elections as long as the conviction stands.

According to the ECP's election schedule, the tribunals are to conclude the hearing of appeals today, and publish a revised list of candidates by tomorrow.

“The withdrawal of nomination papers is scheduled for Jan 12 (Friday) and the final list of candidates will also be released on the same day,” an ECP spokesperson earlier stated.

The allocation of election symbols to the candidates was slated for Jan 13 (Saturday), and the polling would take place on Feb 8, the spokesperson added.


 
The Islamabad High Court (IHC) revoked the stay order on Thursday in the cypher case trial, declaring all proceedings after December 14 null and void.

Good on PTI for not turning the donation drive into a political agenda.

Meanwhile the opposing side tried their level best to sabotage and throttle the drive. You know who you are. Small men in big offices.

The PTI under any circumstances should not take the violent route. Continued pressure will yield results. It might be painstakingly slow, but the result will come.
PTI needs to be a movement, people with the same ideology about bringing reforms in to Pakistan. Noone will be able to stop them. It may take time but imagine 80% of the population supporting PTI and knowing why they support PTI, their mentality and mission will be 100% different than the old parties, they can remove IK but what about 10M Imran Khans? then Pmln, PPP, JUI, Mqm will be finished for good.
 
Khan is a gift and a test for the people of Pakistan. People need to realize that’s it their fight. They have to own it and the desire for change must overcome all their fears.

They have to be reminded how the people who migrated to Pakistan left everything behind just for the sake of living in a Muslim country and that spirit of freedom needs to be revived. Waiting for elections should not be the only strategy. It’s time to mobilize but unfortunately the people of Pakistan have lost all sense of purpose and pride.
