To your point, the article does not state if the judge dismissed the charges prior to or after the detainment by ICE.

I read he dismissed the charge AFTER he was taking into federal custody


And the article describe it was mid-trial, so the trial had not been concluded

He can't be removed (or in legal term "Deposed") in the court proceeding if it was "His" trial until the case is concluded, and that action left no other option but for the judge to dismiss the case because he can't answer it in Federal Custody. Which mean what the Fed did to him is unconstitutional, and he can ask for a Criminal Justice visa to testify against the agent (Which will lead to Permanant Residence) and the court will have to give it to him. Not to mention the lawsuit he may file for civil right violation..

If you are a guest in a country you follow their rules. Very simple. Want to protest ? Go do it in your own country. Else get deported like an animal.

Fair points. No one ever accused Fox of being 100% accurate in their reporting.

Regardless of the above, I suspect this individual has more in his background that may prevent his being able to reenter via Criminal Justice visa.

Just this morning, on the local talk radio station, the ICE representative was discussing the case of a "grandmother from Mexico" who was recently deported. Of course, the usual howls from the left. The ICE representative continued that the grandmother had been previously deported in 1989 for:

1. using a stolen SSN
2. using a stolen ID
3. illegally crossing the border at that time

Sorry, but I have no sympathy here.

I think he is still in the US; he was detained but not deported back to Dominican Republic.

Eitherway, it wouldn't matter, because to be qualified for a U Visa, he would only need to be a victim of either false imprisonment or perjury, according to US state department, the U Applicant do not need a background check when they applies for a visa, he only need to do that when he is adjusting status (from U Visa to Green card) which happened 3 years down the road. Whether or not he can adjust his status is something to be considered 3 years down the road, but he can get a U Visa and a court injunction to stay in the US, and I don't see any reason why his U visa application would be refused.


On the other hand, him getting U Visa is the lease of my concern in this case, him suing the federal government for either human right violation or false imprisonment (or both) is, he can have his green card or get denied, I don't care, I care about when we have to fork out millions of dollars for this particular ICE agent who act before he think. Martell Lebron is going to win that civil suit; the only question is how much we pay

Sorry but you don't make the rules. If you hate yourself you can seek therapy for yourself. There are no rules against protesting or participating in student organizations. Any arrests of such students is illegal and racially/politically motivated. Lawyers and other state officials will push back.

Also you are Indian so mind your own business.
 
Protesting and participation is one thing. Destruction is another. Assault, including verbal, or intimidation against another, is not covered under protesting and participation.

If you are here on a student visa, different rules apply.
