That's actually wrong, once the Federal District court (or immigration court, I forgot which one) gave the order that he cannot be deported to El Salvador. He is no longer a illegal immigrant.

Strictly speaking, once a judge has a decision of a case or processed, and that case does not result in the person's removal, he is no longer an illegal immigrant but a temporary resident, that's how refugee visa work......This is like rounding up a random tourist and then forcibly send them back to their home country, only in this case, there are a court order specifically saying he cannot be send back to El Salvador.

I already can see lawyer jump up and down for this case, especially when SCOTUS have already lay out 9 to 0 to the decision.
