Balochistan refers first 40 terror suspects to faceless courts
ISLAMABAD: In a first, as many as 40 suspects in Balochistan have been referred for trial through faceless courts in accordance with new legislation enacted to end the controversial practice of forced disappearances and instead prosecute such cases through a lawful process.
For two decades, arbitrary detentions remained a burning issue in the insurgency-hit province, with demonstrations and hunger strikes by families of missing persons becoming a regular feature outside the press clubs in Quetta and Karachi.
On a number of occasions, sit-ins were also organised in Islamabad. Successive governments faced a lot of criticism for their failure to arrest this trend.
The new measures stem from amendments to the Anti-Terrorism (Balochistan) Amendment Act 2025, passed into law last year by Chief Minister Sarfraz Bugti’s government through the Balochistan Assembly. A source privy to details confided to The News that around 90 suspects have been detained under the new law on allegations of aiding, abetting and committing acts of terrorism. Five of them have been released after nothing could be established against them, while 40 have been referred for trial pending submission of their challan.
An official source said the law allows arrest of a person prior to the registration of an FIR if the situation warrants it. “That’s why it is called preventive detention or internment,” he said. However, the official explained, the detention is immediately notified, with the information shared with the family, physician and court.
Asked how the case is processed after detention, he said the maximum detention period is 90 days, after which the matter is presented before an oversight board chaired by the Additional Chief Secretary (Home). Nawabzada Jamal Khan Raisani (MNA), Barrister Jehanzeb Bugti, one representative each from Military Intelligence and Inter-Services Intelligence while one psychiatrist and one criminologist are the board’s other members. Cases referred for trial are dealt with by a faceless court, with proceedings conducted through video. The judge is appointed by the Balochistan High Court’s chief justice, and only the chief justice knows his identity; no one else does. Similarly, the identity of the prosecutor is kept confidential. Witness protection is granted to ensure their safety.
Asked how this process would ensure the transparency of the trial, the official acknowledged the challenge and referred to examples from other countries that have dealt with similar situations through faceless courts, citing Italy as a trendsetter in setting up such tribunals to prosecute mafia-related cases. He cited an example of a high-profile case involving an individual considered close to terrorist organisations. “The case was being prosecuted through an open trial. The judge received threats from BLA through foreign numbers. We decided to shift the court to safe premises. A couple of departments refused to provide space for the court lest they become a target of terrorists. The proceeding was then conducted from the jail premises,” he said. Meanwhile, the security of the judge was enhanced: his residence was moved to a safe location, and a bulletproof car and a trained anti-terrorism squad were provided for his protection. The prosecutor in this case experienced similar challenges, he said.
Earlier, a sessions judge in Mastung was killed, and an additional sessions judge dealing with BLA cases in Kharan was kidnapped and later released. Around 50 officials of the Counter Terrorism Department have been killed, including a deputy superintendent of jail. Recently, the driver of a law officer was shot in the head when the officer was inside a building to record his statement about the Ziarat incident, where 27 policemen were killed by terrorists. “People sitting in Islamabad, Lahore and Karachi don’t know the working environment we are in. Think about the officers working in other districts when we are not safe in Quetta,” he said.
