Putting aside your aspiration that this will get reversed, and assuming it remains in force..... Won't existing visa holders be at risk of being let go?

It is not an aspiration. It is a statement of fact. It is now widely reported that the administration has largely rolled back the initial headline plan and people who currently have visas will not be affected by it. My expectation, based on US law and not any aspiration, is that even the other parts of the proclamation will be set aside by courts. I have previously shared my own reasoning as well as those of several US immigration attorneys that is the basis for this expectation. It may be too much to expect you to openly admit that your initial celebration about Indian H1Bs being forced to return home was premature, but at least take into account that I have a better understanding of the legal issues involved than most people posting here.

Actually, if you listened to the rhetoric during the signing, it would mean less foreigners being allowed in speciality occupations by making them very expensive to hire. Basic economics dictates that this would lead to more offshoring, not less, because it would be a lot cheaper to hire the same employee in Canada, UK or India.

That is just an extreme copium mechanism for those who were celebrating prematurely. The courts are still going to be slammed with lawsuits and the administration is still going to lose even on the issue of imposing the tax on employers sponsoring new visas because it remains a huge overreach of executive authority that completely changes the fundamental characteristic of a program set up by Congress. It is just that their losses would be less dramatic because they have voluntarily withdrawn the flagrant violation of due process they had initially contemplated.

If the administration were really serious about this, they would have worked with Congress to amend the law to get a legal basis for their action that would have stood in court.

Not overreach—but I get your bias here.

The President has wide authority over immigration, USCIS, CBP, and SD. He didn’t invent a new law, but working within the legal framework. It is widely known the President has wide discretion over immigration. The fact that you don’t know that just tells me you’re ignorant and just writing what you wish to happen.

Secondly, SCOTUS has ruled that not even federal judges can do nationwide injunctions anymore against the Presidents EO, so even bs lawsuits won’t stop this.

Third, now that the White House has clarified how they will enforce this, this cuts the source of H1B—which is only the beginning.

Oddly enough the text is broad enough that immigration lawyers and tech companies first interpreted as effecting current H1Bs too—any guess why? Because the text is broad enough to allow the WH to enforce it on current H1Bs too.

The writing is on the wall.

Not only will we get you kicked out of America but we’re going to get you kicked out of the Gulf too.

America is a nation not a jobs program for you to scam and defraud.

No, it was not. Even according to the official proclamation that was signed by Trump, the fee would apply to all H1B visa holders if they ever left the US and wanted to re-enter.

Changing history is the latest form of copium.

Indians should focus on India, why so much love for US dollars? These H1B1 visa is not merit base , its only anti China policy. Other countries also have much better skilled workforce.
