Sir, it's not even a "de facto" matter. Please feel free to refer to numerous previous posts about the Strait. Waters within 12 nautical miles perpendicular to a coast are not "international waters". They are territorial waters. The Strait is Omani and Iranian, not international.
Therefore "freedom of navigation" does not apply. Only "innocent passage" applies. Iran has the right therefore to impose terms on passage based on its own determined national security requirements. It can charge a toll and stop and search as it sees fit.
The water, everything below it, and the sky above it all count as either Iranian or Omani territory.
