PENSION WIDOW ONLY, IZHARUL HAQ ONE SUO MOTO

A news item appeared in Daily Jang Karachi as well as in English edition of Daily Dunyianews reading that “Supreme Court of Pakistan” declared that the Pension was the right of the wife of the deceased employee with no share to sisters or brothers.

2. Though this old has since too long learnt that there should be nothing strange in our beloved country , yet was puzzled as he thought today there was a Supreme Court but NOT of Pakistan”. Due to old age he might have delusion that though there today is a Chief Justice of Pakistan but no SC of Pakistan. If the too old age was not bent to fail him, this old remembers before American entry into Afghanistan there existed no railways but since too long there existing a Minister of Railways.

3. I belong to lower middle class. In my childhood there was no concept of subscribing newspapers in homes (mohallahs) except for in large cities like Lahore Karachi. In my high school age I used to read newspaper from the Barbar Shop or in the nearest one ship hotel. Reading was generally one or two pages only as others too had to share reading.

4. Mid 1960s when I came Karachi and got my first job I had direct access to a full reading Urdu daily of my own and full reading of an English one in office. With start of service added with living in Karachi started maturing my vision. Since then I found every foreign tour of our rulers was always very successful, same was every judgement from the Apex court was invariably “landmark” for our print media.

5. The above Decision of the SC is perhaps the first one passing through my eyes which both the above the prints have not labelled “landmark”.

6. Since some years, for obvious reasons in the eyes of suffering ordinary, human rights public interest litigation has stopped. The objection was from black coats as this deprived them from fees. The loudest critic was Choudhary Aitzaz Ahsan on the ground that suo moto deprived one from appeal right. He forgot that public interest litigation belonged to the issues affecting larger segment of the society not individuals hence no one in that case wished an appeal. I still have in original a clip main headline of dailies reading years back “No one will be allowed to loot the public – CJP”. What is today after public interest litigation having gone? The other day Government gave relief in shape of subsidy to low quantity petrol users. The simple question is what to use this complicated procedure. If there was nothing hidden in the intent, then simply the heavy levy on low quantity users should had in the first instant been finished or reduced to that extent rather reimbursing them.

7. The Decision is a feel of real cool after a very long time. Though this old does not wish to request or pray yet he draws attention to a more important issue of the same nature namely the SHC decision on disposal of balance on death of a National Savings investor. SHC declared that entitlement would be as per court given succession certificate not on what the deceased wished during his life time. Due to too old age and poor eye sight I can’t recall the exact wording but the single exclusive master piece article written on the issue entitled “Another suo moto needed” was from columnist Izhar ul Haq explaining how injustice and unnatural the impact of the decision was and drawing the attention of the SC to the need of a suo moto.
