EDMOND, Okla. (KOKH)
— Oklahoma's Secretary of State, Benjamin Lepak, was arrested by Edmond Police on Friday.
Lepak was arrested on suspicion of public intoxication.
According to a police report, an officer found Lepak standing at the drive-through window of McDonald's shortly before 11 p.m. on Friday.
Officers said Lepak had "extremely slurred speech" and could "smell an odor of an alcoholic beverage coming from his breath."
According to the police report, officers asked Lepak what he had been doing. Lepak responded, saying he went to church earlier.
Officers then asked Lepak how much he had to drink. Lepak responded, saying he had nothing to drink.
According to the report, Lepak said he wasn't unsteady on his feet and "again mentioned he was at church with other dads having a gathering."
EPD officers continued to question Lepak, who said his kids just went to a new school and then told officers he had been healthy this week and was avoiding unhealthy food but wanted McDonald's.
Officers claim Lepak was unable to "maintain a coherent train of thought as he spoke about the gathering, his kids at school, and his eating habits."
Lepak allegedly told officers he "got McDonald's, cause this is my night to have McDonald's."
The police report states Lepak volunteered to get an Uber and later told officers he had a beer.
Lepak then backtracked and stated he didn't finish the beer, according to the police report.
Police also noted Lepak drove to the McDonald's, but Lepak later claimed he did not drive to the location, despite his car being parked in the parking lot.
A spokesperson for the Secretary of State's Office released a statement saying:
Mr. Lepak was waiting outside McDonald's for dinner. He was not given a breathalyzer test. Mr. Lepak will address the ticket appropriately through the legal process.
Lepak was appointed acting Secretary of State by Governor Kevin Stitt in 2025. He assumed the role permanently earlier this year.
Before that, Lepak had served as the Governor's general counsel.

There is an Oklahoma law that states public intoxication is grounds for impeachment.
But don't worry for LePac, Oklahoma's Republican Oligarchy will protect him.
It’s not his first arrest for this either. Dude is a drunk.
BTW, Lepac is in charge of Oklahoma elections.
Oklahoma is a very corrupt state.
