Well for one because Tesla was forced to open a plant in Shanghai to get around import tariffs while Chinese companies like BYD have refused year after year to do the same in the US. They just perpetually kicked the manufacturing and selling can down the road for over 15 years.

Keep in mind the Model 3 didn't roll off the line to US customers until July 28, 2017..that's 5 years AFTER BYD could have cornered the US EV market.
