They are beholden not to discriminate on the basis of race or other factors. Indians do this blatantly. 70% of H1-B visas going to Indians is not normal unless there is blatant bias at play.



I already addressed this. Big companies have lots of deadwood and can carry excess fat for a long time. You clearly have not spent much time in management and are not aware how these games are played. There is no way to know what the growth would have been if they had hired on merit instead of nepotism.



Discrimination is against the law so I am entirely correct to point it out. So is everyone else who is pointing out the rampant Indian nepotism.

Your claim that Indians are above average in tech ability is laughably ridiculous and easily disproved. The American market is the richest market in the world and foreign companies vie to get a piece of the pie.

German companies (SAP) have dominated segments of the American market.
Chinese companies (TikTok) have dominated segments of the American market.
Not one single Indian company has dominated the American market. Not a one. How come all these genius Indians have failed miserably to penetrate the American market?

Why is it that Indians only succeed when they work for a Western company? You know the answer. We all know the answer.

If you know white strong workers are being systemically discriminated and being blocked out of tech industry, why don't you disrupt the industry by starting a business that uses this untapped talent pool of white strong workers?

Or if you are short on capital, why don't you float this idea to an investor?

If the companies are having too much dead wood and are not reaching optimal growth path, then its your golden opportunity to make money!

Start a business that disrupts a bloated brown infested company and its business by leveraging superior white talent pool.

Lets see how many investors buy that idea.

In all my years I have never seen someone even attempting that. I saw a lot of bullshit crying but no one really leveraging the white power beyond political goals by virtue of votes or right wing grift.

By your logic, 70% of top valued tech companies should be Indian.

This entire thread is about Vivek's claim that H1-Bs are awarded based on merit.

As part of an H1-B labor certification, the company must prove to immigration that no qualified American worker was available for the job and the company had no choice but to hire the foreigner. We have American workers saying openly that is not the case; that they were fired to make room for the H1-B.

The INA directs the Secretary of Labor to certify that there are not sufficient workers who are able, willing, qualified and available and the employment of an alien will not adversely affect the wages and working conditions of workers in the United States similarly employed.

As I suspected... You are debating about H1B without understanding what it is.

H1B is this much: Speciality Jobs visa. It has no component of merit in it. It only requires one to be able to do speciality jobs. Its requirement is "theoretical or practical application of a body of highly specialised knowledge". Thats all! There is no "merit" part of it.

Employers can seek such people outside USA when they can not fill a position in USA.

It only means Indians wanted to take up those jobs and American employers were not able to find Americans to do those jobs. Thats all!

BTW, many countries have visa options that are not available to Indians.
Like E-2 visa. Like TN-1 visa. Like E-3 visa.

No wonder H1Bs have more Indians. They want to do that kind of work, americans cann't find someone in their country to do it and they do not have other visa options.

At first cut, 70% seems extraordinary. But then India accounts for almost 20% of the world's population. Europe and East Asia has large IT talent but they would be too expensive to take up the sort of jobs which are offered to H1Bs. Then we have Africa, Greater Middle East (incl Pakistan and Bangladesh)- we know what kind of talent is available there! South East Asia is largely not English speaking. Once you adjust for all of that, 70% seems reasonable.

They are well paid jobs, one of the Indian consultancies might charge say 150k for perhaps a 200k job, the h1b would get a cut of the 150k, probably enough as a living wage

In general, some jobs have been identified to be junior or grad level sort of jobs, no reason it should go to anyone other than an American , you can't surely say h1b guys should get these jobs....

I already posted a link to the DOL website. An H1-B can ONLY be awarded after an LCA is obtained, and the LCA can only be granted when the company asserts under penalty of perjury that the hiring will not displace an American worker. We have any number of American workers saying they were fired to make room for an H1-B.

Except that we have all these Americans saying the exact opposite: that they were fired and forced to train H1-B to replace them.

People have been saying this literally for decades. It is only getting mainstream media attention now.
